FinPod Card Terms and Conditions

The “FinPod Card” is a reloadable Visa prepaid card authorized by FinPod Limited (“FinPod”). issued and operated by ePayLinks Technology Company Limited (“ePayLinks”).

 

This document sets out the Terms and Conditions of the FinPod Card (“T&C”) and applies to both individuals who apply for and hold a FinPod Card (“Parent Cardholder”) and their children on whose behalf the cards are issued (“Child Cardholder”) (each refered to as “FinPod Cardholder”).Please read these T&C carefully before you apply, activate or use the FinPod Card. Applying your FinPod Card indicates that you accept and agree to be bound by these T&C. 

 

These T&C supplement the FinPod Terms of Service and ePayLinks Terms and Conditions and together, they govern your FinPod Card.

 

“You” or “your” in this agreement means the FinPod Cardholder (including Parent Cardholder and Child Cardholder), and “We” or “us” means FinPod Limited and/or ePayLinks Technology Company Limited.

About ePayLinks

FinPod Cards are issued and operated by ePayLinks. ePayLinks is an authorized deposit-taking institution. It holds a Stored Value Facilities license and is regulated by the Hong Kong Monetary Authority. It is also a member of Visa. ePayLinks is responsible for these T&C.

ePayLinks provides certain customer services to FinPod Cardholders through their Global Cash Website indicated below and the Global Cash Hotline below in relation to the FinPod Card. These services include replacing lost and stolen FinPod Card services and assisting the Parent  with any queries they may have regarding the FinPod Card. ePayLinks may reach you directly for matters in relate to your Card.

About FinPod

FinPod Limited (“FinPod”) is the operator of the “FinPod Website” (https://finpod.io) and the “FinPod App”. By registering with FinPod on FinPod Website and the FinPod App, you will also be subject to the T&C relating to the FinPod Website and the FinPod App and the services that FinPod provides, which you can read at  In case of any discrepancies between the terms and conditions of the FinPod Website and the FinPod App, these T&C will apply.

1. About the FinPod Card (“Card”)

FinPod Card is a reloadable Visa prepaid card issued and operated by ePayLinks. It allows you to store value, pay for purchases and make a transfer between a Parent Cardholder and Cardholder Child using the FinPod App.

 

It is not a bank account and the value stored in the FinPod Card is not a bank deposit. You will not be paid any interest on the value you store in the FinPod Card(s).

 

That amount and any pending transactions are not protected by the Deposit Protection Scheme in Hong Kong. ePayLinks will hold the funds for you “in trust”, which are projected by the trust arrangement.

 

We may introduce new FinPod Card or services, vary or suspend any existing FinPod Card or services, and/or close or withdraw any existing FinPod Card or services at any time without prior notice. The service provider FinPod Card or services may be replaced at any time, which may require the replacement of the FinPod Card.

We may accept or refuse any application or request for any FinPod Card and/or services at our sole discretion.

 

In case of any disputes, the decision of FinPod and/or ePaylinks shall be final.

2. Opening a FinPod Card

After you apply for a FinPod Card with us, we may need you to complete the required steps (including but not limited to conducting face ID or sending SMS messages to you) for verification and activation process. We may also request you to conduct a first-time fund-in as the initial stored value for your FinPod Card.

 

Upon your FinPod Card approved and issued by ePayLinks, you can access or view your virtual FinPod Card on FinPod App. The virtual FinPod Card will be ready for use immediately (unless we ask you to follow activation steps, or any further information ). 

 

Physical FinPod Cards are only available for certain membership tier. To use a physical FinPod Card, you are required to provide valid identity documents, information and personal data for review and approval. Before you can use the physical FinPod Card, you need to activate it in accordance with the instructions prescribed by us from time to time

 

The FinPod Card will remain as property of FinPod and is non-transferable. We may suspend, downgrade, cancel or refuse to re-issue, renew or replace the FinPod Card without giving you any notice or reason. You must immediately upon demand surrender the FinPod Card to us.

3. Child Cards and Parent Liability

A Parent Cardholder can apply a FinPod Card to their child(ren). The Child Card(s) will be issued on behalf of the Parent. The maximum number of Child Cards that a Parent can apply will depend on their FinPod membership tier.

It is recommended that a FinPod Card is to be issued to a Child who is 6 or above at the time that the Parent initially applies for the Child to be a Cardholder.

As a Parent Cardholder, you have full control and responsibility for all FinPod Cards issued on your behalf (i.e. including the Parent and Child Cards). That means:

 

  • You will be liable for all the transactions (including all related fees and charges) carried out by the use of each FinPod Card and each PIN, i.e. including the Parent Card and PIN and the Child Card and PIN;
  • You have to ensure that each Child Cardholder uses and handles his/her FinPod Card and related matters in accordance with these T&C;
  • You will be responsible for the use of the FinPod Card by a Child Cardholder and any failure to comply with these T&C by any Child Cardholder;
  • You have to explain to your Child Cardholder, the content of these T&C, how to use the FinPod Card, keep their FinPod Card and security details safe and report lost immediately if their FinPod Card is lost or stolen or if any data or security details are no longer safe.

By applying a FinPod Card for a Child Cardholder, you (as the Parent) authorize FinPod and ePayLinks to provide and exchange your and the  Cardholder information about the FinPod Card for the purposes of their use of the FinPod Card (including personal and  transactional information).

 

Different types and levels of limits (eg maximum stored value, annual transaction amount, daily spending limit) are applied to FinPod Card, and these limits will be shared entirely by the Parent Cardholder and all his/her Child Cardholders.

 

Parents can request to set specific limits for certain merchant categories for their Child Cardholder’s Card(s) through the FinPod App.

 

In no circumstances will FinPod or ePayLinks be liable to the Parent Cardholder or Child Cardholder because a transaction on the FinPod Card was conducted and processed where the Parent Cardholder had themselves placed a restriction on the Cardholder for a particular type of transaction.

4. Use of the Card

The FinPod Card can be used at any permitted merchants where Visa cards are accepted (including online purchase transactions). Certain merchants/merchant types may nevertheless be blocked by our system to prevent inappropriate uses of the FinPod Cards (such as, but not limited to, selling weapons, drugs, copycat software, and gambling, etc.).

You can make a transfer between Parent Cardholder and Child Cardholder using the FinPod App, withdraw cash through an ATM using physical Cards and the FPS services depending on your membership tier once the services are made available.You can always check your Cardholder Card balance and transaction records via the FinPod App. Balances may not always be reflected correctly due to transactions still being processed, including but not limited to chargebacks and disputes, refunds, processing errors or delays in transaction processing.

Before you make a purchase or transaction, you should always ensure you have sufficient available funds to cover the amount of the transaction and any applicable fees which will be deducted from the balance of the FinPod Card.

If any transaction takes you over the available funds or the FinPod Card limit in force, the transaction will be declined and you may be charged an Inappropriate Card Usage Handling Fee as defined and set out in the fee schedule provided on FinPod and ePayLinks’ official website. (the “Fee Schedule”). 

Your FinPod Card can be used for transactions in a currency other than Hong Kong dollars and a fee will be applied for doing so (for any further details, please refer to the  Fee Schedule). The transaction will be converted to Hong Kong dollars at a rate determined by the Relevant card scheme (Visa) and/or ePayLinks on the date the payment is processed. You can check the amount deducted from your FinPod Card after the transaction is settled via the FinPod App.

We may at any time and at our sole discretion,  stop, suspend or restrict the FinPod Card or refuse to accept or execute a particular FinPod Card transaction (including top-up, transfer or payment) if:

 

  • there are insufficient available funds in the FinPod Card to cover the amount of the transaction and any applicable fees;
  • executing the transaction would breach any limit applicable to the FinPod Card;
  • the FinPod Card is inactive, blocked/suspended, expired, canceled/terminated;
  • transaction validation failed for a number of attempts;
  • abnormal transactions on the FinPod Card appear many times;
  • we are concerned about the security of or access to the FinPod Card or security credentials;
  • we suspect the FinPod Card or security credentials are being used in an unauthorised or fraudulent manner;
  • we have reasonable grounds to believe that you are not complying with these T&C or there is a breach of the any applicable laws or regulation;
  • we deem it reasonably necessary to do so.

FinPod and ePayLinks do not warrant or accept any responsibility if a merchant does not accept the FinPod Card, nor are they responsible in the event that the Cardholder has a dispute regarding the goods or services purchased with the FinPod Card. You must resolve any complaint against any merchant yourself and no claim against any of them may be made against or set off against us. If you cannot resolve the dispute with the merchant, you may contact ePayLinks directly  for help in circumstances where:

 

  • the transaction is not recognized by you;
  • you haven’t authorized the transaction;
  • you did not receive the goods or services to which the transaction relates;
  • the transaction amount differs to the purchase amount; or
  • you believe a transaction has been duplicated.

Unsuccessfully disputed transactions will be placed on your FinPod Card and you will be responsible for all fees and interest from the date that transaction is recorded. For any successful refund from a merchant, a refund processing fee may be charged according to the Fee Schedule.

5. Card Limits and Fees

We may, at our sole discretion,  specify any conditions or limits relating to the use of FinPod Card and set out in the Limits Table (on FinPod and ePayLinks’ official website). These conditions or limits may include (but not limited to):

 

  • maximum stored value;
  • annual transaction amount;
  • daily limits on spending, transfer, FPS and ATM withdrawal;
  • transaction limits on spending, transfer, FPS and ATM withdrawal. 

You may apply to increase the FinPod Card limits by upgrading your FinPod membership tier (upon this functionality is available on the FinPod App) and you may need to go through identity verification and personal information checks as reasonably required.  Increasing your FinPod Card limit increases your potential liability for monetary loss if the Parent Card Information is lost or stolen, there are fraudulent or unauthorized transactions on the Parent  Card, or FinPod becomes insolvent or suffers from a system failure.

 

You are required to pay the fees and charges in respect of the FinPod Card in accordance with the Fee Schedule (on FinPod and ePayLinks’ official website), or as we may notify you.  These fees may include (but not limited to) charges applying to:

 

  • cross-border/non-default currency transaction;
  • penny amount online transaction;
  • atm cash withdrawal;
  • balance check through atm;
  • dormant card, expired management fee;
  • inappropriate card usage handling fee (eg multiple declined, multiple refund transactions);
  • card cancellation/replacement;
  • chargeback application.

The Limits Table and Fee Schedule provided by FinPod and ePayLinks only represent the fees, limits, and restrictions directly imposed by these entities. However, please be aware that additional fees, limits, or restrictions may be imposed by other parties, such as resellers, service operators, or merchants. These third-party fees and restrictions are set independently by the respective companies and are not charged or controlled by FinPod or ePayLinks. Consequently, they fall outside the purview and control of FinPod and ePayLinks.

For example, resellers may charge a service fee for transactions or impose their own limits on the amount of value that can be added to or withdrawn from the FinPod Card. Service operators, such as ATM providers or payment gateway services, may impose additional transaction fees, withdrawal limits, or other restrictions based on their own policies and operational guidelines. Merchants may also set minimum or maximum purchase amounts or apply additional charges for processing payments with the FinPod Card.

 

6. Card Expiry, Renewal and Cancelation

There is an expiry date for each FinPod Card which can be viewed on the FinPod App. A FinPod Card cannot be used for payment transactions after its expiry date.

 

You may apply for renewal of your FinPod Cards(s) before the expiry date through FinPod App or the means we communicate to you. The FinPod Card number may change for the new FinPod Card issued to you after renewal. You can request to transfer the remaining value on your existing FinPod Card to the new Card. In certain circumstances, we may renew the FinPod Card for you upon expiry, you shall be deemed to have consented to our issuance of such renewal FinPod Card. 

 

You may request cancellation of your FinPod Card at any time at a card cancelation fee. We will not cancel your FinPod Card only because your FinPod Card has expired unless you require it. If your FinPod Card has expired but not be canceled, an expired card management fee (details refer to Fee Schedule) will apply. 

 

You are encouraged to use up the remaining value prior to the cancellation, or a handling fee will incur if you need to raise a refund for your remaining value.

 

You still need to bear all risks and responsibilities from the use of the FinPod Card even the FinPod Card was canceled, including any payment/charge from pre-authorized transactions which you subscribed from or authorized to any merchants (such as subscription of services), or any automatic payment settings.

 

You may apply to replace a FinPod Card when your card cannot be used for any reasonable reasons (such as physical card broken). A replacement card will be arranged for you at a card replacement fee (for details please refer to the Fee Schedule). After the FinPod Card is replaced, the unsettled transactions (including refund) will be performed by the new card. The payment method you subscribed with the pre-existing FinPod Card may be invalid, you have to reset the subscription services you need with the new FinPod Card.

 

You should cut out the physical card immediately after the FinPod Card cancellation for security reasons.

7. Your Responsibilities

FinPod Card must not be used for illegal purposes (including the purchase of goods or services deemed illegal by any Hong Kong Law), and must not be sold to any other third party.

You must not allow any other person to use your FinPod Card. You remain fully responsible and liable for any activities undertaken with respect to the FinPod Card(s) by any user.

 

You are responsible even if:

(i) you do not sign a sales slip (including where a transaction may be effected by telephone, mail, electronic means or direct debit arrangement without a sales slip or without your signature) or the signature on the sales slip is different from the signature on your FinPod Card; or

(ii) the transaction is effected involuntarily.

 

You should make sure your contact details registered with us are up-to-date and you have allowed us in your mobile settings to send you push notifications via FinPod App, for the purpose to allow the important notifications from us to be delivered to you on a timely basis.

 

Dormant: You are recommended to use the FinPod Card and check the FinPod Card balance and transaction records regularly in order to identify any unauthorised transactions. If there is no transaction on your FinPod Card (top-up, transfer or purchase) for a continuous period of 6 months (the “Dormancy Period”), your FinPod Card will become dormant and a dormancy fee (for details please refer to the Fee Schedule) will be charged every month commencing on the first month following the Dormancy Period.  The dormancy fee may deplete the funds in the FinPod Card completely. This fee will continue to apply (even after expiry of any FinPod Card) until the date you withdraw all your balance, or there is a top-up or transaction made on the FinPod Card.

 

Security measures: You should take appropriate securities measures including the following:

 

  • sign on the FinPod Card immediately after receiving the physical card;
  • keep your FinPod Card and mobile device in a secure place;
  • keep your PIN strictly confidential;
  • if the PIN is or may have been seen by another person, change it promptly;
  • do NOT allow anyone else to use the FinPod Card or your mobile device which may be used to access the FinPod Card or your PIN (or security credentials);
  • do NOT write down your PIN (or security credentials) in a way that someone else could understand them;
  • do NOT access or store the virtual FinPod Card in a device with any pirated, hacked, fake or unauthorised application or where the software lockdown has been overridden (such as “jailbroken” or “rooted” device);
  • do NOT take any action to disable any function provided by your mobile device, and/or agree to any settings of your mobile device that would compromise the security of the use of your virtual FinPod Card or mobile device.

 

Report Lost: You should promptly lock your FinPod Card via FinPod App and report to us any loss, theft, disclosure or unauthorised use of your Card, PIN or Mobile Device. We recommend canceling that FinPod Card and reissuing a new one for you to protect your interests. You will be responsible for all transactions effected by the use of your FinPod Card or PIN before we receive your report.

 

Unauthorised or incorrectly executed transactions:  If a transaction to or from your FinPod Card is executed incorrectly or a transaction has not authorised, you must notify us without delay and in any case within 30 days of the transaction being debited to the FinPod Card. Otherwise, you should bear the risk of the deal and responsibility. If you notify us within this timescale, you may be entitled to a refund of that transaction through applying for chargeback (details refer to FAQ).

 

You are liable for all losses and damages in respect of the use of the FinPod Card if you have:

 

  • acted fraudulently or grossly negligently;
  • failed to inform us as soon as reasonably practicable after becoming aware that the FinPod Card has been lost, stolen or the security credentials or FinPod Card information had been disclosed to an unauthorised person; or
  • failed to follow the safeguards or comply with your obligations under this Section or other recommendations of us from time to time regarding the safety and security of the FinPod Card, FinPod Card information and the security credentials.

8. Privacy

FinPod and/or ePayLinks may collect your personal information:

 

  • to identify you in accordance with the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO) and Visa scheme rules;
  • to provide information about a product or service;
  • to consider your request for a product or service;
  • to provide you with a product or service;
  • to assist in arrangements with other organizations in relation to the provision of a product or service or suspend its operation until it is provided;
  • to perform administrative and operational tasks (including systems development and testing, staff training, and market or customer satisfaction research);
  • to prevent or investigate any fraud or crime (or a suspected fraud or crime); and/or
  • as required by relevant laws and scheme rules.

In some circumstances, FinPod or ePayLinks may collect your personal information from a third-party service provider. FinPod or ePayLinks may collect information from other participants in the payments system and other financial institutions in order to resolve disputes or errors. FinPod or ePayLinks collect this information in order to manage the service they provide to you, consistent with these T&C.

If you do not provide some or all of the information requested, FinPod or ePayLinks may be unable to provide you with a product or service (as applicable).

FinPod and ePayLinks may provide your information:

 

  • to each others;
  • to another member of its group;
  • to any outsourced service providers (for example mailing houses, fraud and anti-money laundering service providers, data switch service companies);
  • to regulatory bodies, government agencies, law enforcement bodies and courts;
  • to other parties as is authorized or required by law; or
  • to participants in the payments system and other financial institutions for the purpose of resolving disputes, errors or other matters.

FinPod or ePayLinks will not collect sensitive information about you, such as health information, without your consent.

To facilitate transaction identification and to assist with the identification of suspicious or fraudulent transactions, your personal information and transaction details may be sent to regions other than Hong Kong. By using the FinPod Card, you agree that your personal information and transaction details may be sent overseas for the purposes of assisting with the identification of suspicious or fraudulent transactions or as required by law.

9. Anti-Money Laundering and Counter Terrorism Financing

You acknowledge and agree that:

 

  • where required, you will provide to FinPod or ePayLinks all information reasonably requested by it in order for FinPod or ePayLinks to comply with the fraud monitoring and anti-money laundering and counter terrorism financing obligations imposed on it pursuant to Anti-money Laundering and Anti-terrorist financing regulations and guidelines;
  • Failure to provide any reasonably requested identification documentation may result in ePayLinks or FinPod being required to withhold or suspend the FinPod Card(s) until the requested documentation has been provided or is satisfactory, at its sole discretion.
  • FinPod or ePayLinks may be legally required to disclose information about you or the Cardholder to regulatory and/or law enforcement agencies;
  • FinPod or ePayLinks may block, delay, freeze or refuse any transactions where FinPod or ePayLinks in its sole opinion considers reasonable grounds exist to believe that the relevant transactions are fraudulent, in breach of the anti-money laundering legislation, sanctions legislation or any other relevant law;
  • where transactions are blocked, delayed, frozen or refused by FinPod or ePayLinks in accordance with these T&C you agree that FinPod or ePayLinks is not liable for any loss suffered by you or other third parties arising directly or indirectly as a result of FinPod or ePayLinks taking this action; and
  • where required, FinPod or ePayLinks will monitor all transactions, which arise pursuant to the use of the FinPod Card, in accordance with its obligations imposed on it in accordance with the anti-money laundering legislation and sanctions legislation.

10. Changes to the T&C

While these T&C T&Care up to date on the date they were prepared, we may make changes to these T&C from time to time.

Updates to these T&C that we consider (acting reasonably) are not materially adverse to you may be made without notifying you but by updating the version of the T&C that are available on the  FinPod Website and the changes will take from the date the updated version is posted on the website. The T&C available at FinPod’s website will be the latest version and will be available at no cost to view at any time. You may download a copy of the latest version of the T&C from the same webpage, or request a paper or electronic copy free of charge by contacting FinPod.

If you wish to cancel the FinPod Card(s) as a result of any change or variation FinPod or ePayLinks makes to the T&C that is materially adverse to you, you must contact FinPod or ePayLinks to cancel the FinPod Card(s). In these circumstances, FinPod and ePayLinks will not charge a cancellation fee or any other fee in respect of FinPod or ePayLinks returning any Value stored in the Card(s) to you.

11. Governing Law and Jurisdiction

These T&C shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
